Hazing Lawsuits
Jack Ivey and Judith Ivey, As Heirs and Representatives of the Estate of Jack Ivey, Jr. vs. Phi Kappa Sigma, et al, In the 342nd Judicial District Court, Tarrant County, Texas 

This lawsuit involved the wrongful death of Jack Ivey, a member of the Phi Kappa Sigma fraternity at the University of Texas at Austin as a result of alcohol poisoning.  The Plaintiffs alleged that the fraternity made beer available to minors, encouraged drinking games, intimidated members of the pledge class through paddling and by screaming at them while blindfolded, among other tactics. The lawsuit alleged that members and pledges of the fraternity after engaging in a drinking game, stripped Jack Ivey down to his underwear, wrote on his body, tied him up and then took him to the  front yard of the fraternity house on the night of his death.

The lawsuit was eventually settled, and the fraternity agreed to a yearlong probation as part of a plea agreement.

Hazing Lawsuits
David Mullins, Individually, and Karen Chambers McAllister, Individually, and Both as Heirs to and Representatives of the Estate of Zachary Mullins, Deceased vs. Delta Sigma Phi Zeta Zeta Chapter et al; Cause No. 2003-522279; In The 99th Judicial District Court of Lubbock County, Texas.

This wrongful death lawsuit was brought by the parents of Zachary Mullins, a member of Delta Sigma Phi, Zeta Zeta Chapter at Texas Tech University against the National Chapter of the fraternity, the Local Chapter of the fraternity and 47 of is members following the fraternity's initiation of new members into the fraternity.  Thomas Herald and Rachel E. Montes
teamed up to represent all interests of the family in the lawsuit against the fraternity and its members. 

The case focused on the fraternity's failure to provide safe transportation to fraternity events and the hazing of pledges during the initiation ceremonies. 
Prior to and during the initiation ceremonies, pledges of the fraternity were deprived of sleep for long periods of time and participated in numerous activities that certain pledges admitted involved hazing.  After the initiation ceremonies, a sleep-deprived active/officer of the fraternity fell asleep while driving back to Lubbock several times before telling one of the sleep-deprived pledges to drive.  Shortly thereafter, the pledge fell asleep behind the wheel and lost control of the vehicle.  Zachary Mullins was killed in the collision that followed. 

Although originally the members of the fraternity denied any hazing was involved in the death of Zachary Mullins, depositions eventually revealed not only numerous instances of
admitted hazing, but that an officer of the fraternity instructed the pledge to lie to the police about the activities of the fraternity.
